Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the SafeRetireCA online platform, including all associated mobile or desktop applications, dashboards, and application-programming interfaces (collectively, the “Services”). SafeRetireCA Inc. (“SafeRetireCA,” “we,” “our,” or “us”) offers subscription-based tools designed to help Canadians evaluate retirement readiness, model future income, and monitor contribution strategies. By visiting, registering for, or using the Services, you (“Subscriber,” “you,” or “your”) acknowledge that you have read, understood, and agree to be legally bound by these Terms.
Agreement to Terms
You accept these Terms by (a) creating an account, (b) clicking “I Agree,” “Accept,” or a similar button, (c) signing an order form or statement of work that references these Terms, or (d) otherwise accessing any portion of the Services. If you act on behalf of an organization, you represent that you have authority to bind that entity; in such case, “you” also refers to the entity. If you do not agree with every provision herein, you must not use the Services.
Description of Services
Depending on your subscription tier, the Services may include:
Contribution Dashboard – secure aggregation of RRSP, TFSA, pension, and non-registered balances from supported financial institutions;
Income-Projection Engine – scenario modelling that estimates future retirement income under adjustable assumptions for inflation, longevity, market returns, and CPP/OAS benefits;
Goal-Tracking Toolkit – personalised targets, gap analyses, and automated alerts when contributions deviate from plan;
Education & Resources – articles, webinars, and calculators covering Canadian tax rules, withdrawal strategies, and estate-planning basics; and
Export Utilities – downloadable summaries in PDF or CSV for discussion with licensed advisors or for inclusion in financial plans.
The Services provide analytical and educational support only; they do not constitute individualized investment advice, portfolio management, tax preparation, or legal counsel, and no fiduciary relationship is created.
Subscriber Responsibilities
You agree to:
provide accurate, current personal and financial information and update it promptly;
maintain the confidentiality of usernames, passwords, and multi-factor credentials and restrict access to authorised users only;
review imported data and generated projections for accuracy before relying on them;
obtain professional advice before acting on any recommendation that could affect investments, taxes, or estate plans;
comply with all applicable laws, including federal and provincial privacy statutes, when uploading personal or third-party data; and
notify us without undue delay of any suspected unauthorised account use or security incident.
Limitation of Liability
To the fullest extent permitted by law, SafeRetireCA and its affiliates will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Services, even if advised of the possibility of such damages. Our aggregate liability for all claims under these Terms will not exceed the subscription fees you paid during the twelve (12) months immediately preceding the event giving rise to liability. Nothing in this section limits liability that cannot legally be limited, including liability for fraud or wilful misconduct.
Intellectual Property
All software, algorithms, models, user interfaces, documentation, trademarks, and logos forming or generated by the Services are the exclusive property of SafeRetireCA or its licensors and are protected by Canadian and international intellectual-property laws. Subject to your ongoing compliance with these Terms, you receive a non-exclusive, non-transferable, revocable licence to use the Services solely for your personal retirement-planning purposes. Except as permitted by mandatory law, you may not copy, modify, reverse-engineer, decompile, distribute, or create derivative works from any part of the Services.
Governing Law and Jurisdiction
These Terms are governed by, and construed in accordance with, the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the courts located in Toronto, Ontario, and each party irrevocably submits to the jurisdiction of those courts.
Termination of Access
We may suspend or terminate your access to the Services: (a) upon thirty (30) days’ written notice if you materially breach these Terms and fail to cure within that period; (b) immediately if required by law, regulatory order, or court judgment; or (c) if you become insolvent or cease business. Upon termination, your right to use the Services ends, but Sections 5–7 and 9–11 survive. Provided all outstanding fees are paid, you will have thirty (30) days from the effective termination date to export your data via our standard export tools.
Refund Policy
Subscription fees are billed in advance. You may cancel at any time; cancellation takes effect at the end of the current billing cycle. If you cancel within fourteen (14) days of your initial purchase and have not generated more than one comprehensive projection report, you may request a full refund. After that threshold or after the fourteen-day period, fees are non-refundable except where consumer-protection legislation requires otherwise.
Changes to Terms
We may revise these Terms to reflect changes in law, industry standards, or product functionality. Updated Terms will be posted on our website with a revised “Effective Date.” Material changes become effective thirty (30) days after posting; we will also notify active Subscribers by email or in-app notice. Your continued use of the Services after the effective date constitutes acceptance of the amended Terms.
Effective Date
These Terms and Conditions are effective as of 18 June 2025 and apply to all access to or use of the Services on or after that date.
